1. Eligibility and account access

You must be at least 18 years old and legally capable of entering a binding contract to use ClarityApex. You are responsible for the accuracy of the information you provide and for activity carried out under your account.

• Accounts are created or accessed using email sign-in codes or supported third-party sign-in methods such as Google.
• You must keep your email account secure and tell us promptly if you suspect unauthorised access.
• We may refuse, suspend, or terminate access where we reasonably believe these terms have been breached or the service is being misused.

2. Free trial and free features

New accounts currently receive a 14-day Pro trial without needing to provide card details. When the trial ends, the account automatically moves to the Free plan unless you choose a paid option. Dashboards and calculators may remain available on the Free plan, while Pro features can be restricted.

We may change the length, availability, or eligibility rules for free trials and free features in the future.

3. Paid plans, billing, and cancellation

ClarityApex currently offers a monthly Pro subscription and a fixed 60-day Pro access option. Prices, taxes, billing intervals, plan names, and included features are shown at checkout and may change for future purchases.

• Monthly subscription: Recurs monthly until cancelled. You can manage cancellation and payment details through the Stripe billing portal where available.
• 60-day access: A one-time payment that gives Pro access for 60 days from successful payment. It does not renew automatically.
• Payment processor: Payments are handled by Stripe. We do not store full card numbers on our systems.
• Failed or disputed payments: We may suspend or downgrade access if payment fails, is reversed, or is suspected to be fraudulent.

Subscription customers can cancel before the next billing cycle to avoid future renewal charges. For 60-day access, contact us within 48 hours of purchase if there is a problem. Refunds are handled at our discretion except where required by law.

4. Permitted use

ClarityApex is provided for your own personal or internal business property research. You may view, save, annotate, export, and share limited outputs with colleagues, clients, lenders, solicitors, accountants, or other advisors for deal evaluation.

You must not:

• Resell, sublicense, redistribute, or bulk-download our software, datasets, scoring, or outputs as a competing product.
• Use bots, scraping, crawling, or automated extraction unless we have expressly agreed in writing.
• Attempt to bypass access controls, rate limits, payment checks, security controls, or technical restrictions.
• Upload or submit unlawful, infringing, misleading, or harmful content.
• Use ClarityApex to make decisions on behalf of others without appropriate professional judgement and disclosure.

5. No financial, tax, legal, mortgage, or estate agency advice

ClarityApex provides research software and informational tools only. We are not a financial advisor, tax advisor, solicitor, mortgage broker, surveyor, valuer, or estate agent. Our calculations, rankings, AI outputs, alerts, comparables, forecasts, and commentary are not advice or recommendations to buy, sell, rent, finance, or invest.

You are responsible for checking the accuracy and suitability of any property data, financial assumptions, tax treatment, borrowing terms, market evidence, and legal position before making a decision. You should obtain professional advice where appropriate.

6. Data, calculations, and AI outputs

Property data can be incomplete, delayed, estimated, incorrect, or subject to change. Calculations depend on the assumptions entered by you or stored by the platform, such as purchase price, rent, interest rate, deposit, maintenance, tax, and fees. AI-assisted analysis may summarise available data, highlight risks, or generate suggested next steps, but it can be wrong and should be reviewed carefully.

We do not guarantee that listings are available, accurately described, financeable, compliant, profitable, or suitable for your circumstances.

7. Third-party services and links

The service may rely on or link to third-party services, including payment processors, authentication providers, hosting providers, mapping tools, email services, analytics tools, AI providers, and property data sources. Third-party websites and services are governed by their own terms and policies.

8. Intellectual property

ClarityApex and our licensors own the platform, software, design, branding, proprietary datasets, scoring logic, generated labels, and content unless stated otherwise. You receive a limited, revocable, non-exclusive, non-transferable licence to use the service in line with these terms.

9. Availability and changes

We aim to keep ClarityApex reliable, but we do not guarantee uninterrupted access. Features may be changed, limited, suspended, or withdrawn for maintenance, security, commercial, legal, data-source, or product reasons.

10. Limitation of liability

To the fullest extent permitted by law, ClarityApex will not be liable for indirect, incidental, special, consequential, or investment-related losses, including lost profit, lost opportunity, loss of data, loss of goodwill, or losses arising from reliance on property data, calculations, or AI outputs.

Our total liability for any claim relating to the service will not exceed the fees you paid to us in the twelve months before the claim arose. Nothing in these terms limits liability that cannot legally be limited.

11. Termination

You may stop using ClarityApex at any time. We may suspend or terminate access if you breach these terms, misuse the service, create risk for the platform or other users, or if we discontinue all or part of the service. Sections intended to survive termination, including payment obligations, intellectual property, disclaimers, liability limits, and governing law, will continue to apply.

12. Governing law

These terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction over disputes arising from or relating to these terms, except where applicable consumer law gives you mandatory rights in another jurisdiction.

13. Changes to these terms

We may update these terms to reflect product, pricing, operational, legal, or regulatory changes. Material changes may be notified by email or in-app notice. Continued use after the effective date means you accept the updated terms.
